The petitioner seeks bail in a case under Section 414/34 of the Indian Penal Code and under section 8, 20(b) (ii) (B), 25, and 29 of the N.D.P.S. Act.

The police apprehended the petitioner, Raj Kishore Raut, from a motor cycle and from another motor cycle Md. Afroj and Ramesh Sah were apprehended. From the possession of the petitioner only his ATM card and other articles belonging to him were recovered but no narcotic substance was recovered from the possession of the petitioner. 17 packets each containing 500gm of Charas are said to have been recovered from the possession of Md. Afroj.

Patna High Court Cr.Misc. No.38939 of 2015 (2) dt.04-09-2015 2/2 Considering the facts aforesaid and the fact that no narcotic substance was recovered from the possession of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge- West Champaran at Bettiah in NDPS case No. 19/2014 arising out of Ram Nagar P.S. Case No. 172 of 2014.
