Petitioner seeks bail in a case registered for the offences punishable under Sections 354, 354(A), 354(B), 354(C), 120(B) of the Indian Penal Code as well as Section 66 of the Information Technology Act and Section 8 of the POCSO Act.

The statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure reveals that she had voluntarily gone along with Nikhil @ Ajay to visit Barabar Hill and after return from there near the Banabar Halt, Nikhil allegedly ravished her. Patna High Court CR. MISC. No. 33356 of 2019(4) dt.27-09-2019 2/2 a video footage. The victim did not identify anyone. However, the petitioner has been identified in the video footage. Petitioner is in custody since 09.02.2019. Petitioner has got no criminal antecedent.

Considering the material aforesaid and the fact that since other co-accused have been allowed bail by a co-ordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Makhdumpur Police Station Case No.48 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
