The petitioner apprehends his arrest in CI Case No. 1304 of 2018, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

Prosecution case in brief is that informant paid Rs. 1,51,000/- through cheques and cash to the petitioner on the pretext of providing land on cheaper rate at Muzaffarpur, but neither land was provided to the complainant nor money was returned to him.

It is submitted that petitioner is ready to pay the

Patna High Court CR. MISC. No.45296 of 2021(5) dt.11-07-2022 2/2 amount of Rs. 1,51,000/- to the complainant in two instalments within a period of six months.

In view of the undertaking given by this petitioner that he is ready to pay the entire amount of Rs. 1,51,000/- to the complainant in two instalments within a period of six months, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Sitamarhi in connection with CI Case No. 1304 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

On payment of entire money to the complainant within the stipulated period, provisional bail granted to the petitioner shall be confirmed by the court below itself. (Prabhat Kumar Singh, J) vinita/- U T
