2. Petitioner seeks regular bail in connection with Barun P.S. Case No. 67 of 2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 112 litres country made liquor was recovered from a tempoo.
4. It is submitted by learned counsel appearing on behalf of the petitioner that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused in this case only on suspicion. Petitioner
Patna High Court CR. MISC. No.33366 of 2025(2) dt.18-07-2025 2/2 is in custody since 23.04.2025 and he claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application of the petitioner and submits that he is the owner of the seized vehicle.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-Cum-Exclusive Special Judge, Excise Court No.1, Aurangabad in connection with Barun P.S. Case No. 67 of 2019.
