The petitioner by way of this writ petition claims consideration for promotion from the post of Plant Collector to the post of Store Keeper. It is contended that he was never granted promotion during 39 years of satisfactory qualifying service and the post of Store Keeper is lying vacant. In the same breath, it has been stated in the petition that the petitioner was granted twice time bound promotions on 22.02.1992 & 22.02.2005.

It is only when the exercise of the promotion is being conducted then a right of consideration arises and mandamus for directing to make promotions is not, therefore, available under the scheme of the Constitution and service jurisprudence. The writ petition is mis-concieved and accordingly dismissed.
