Petitioners apprehend their arrest in Palanwa P.S. Case No.110 of 2017, registered under Sections 307, 379 and other minor Sections of the Indian Penal Code.

The informant named six persons in the FIR including all the four petitioners and alleged that they all having armed with different weapons came and began to abuse his son. They also assaulted with stick and sharp edged weapon. Vijay Ram assaulted his son-in-law, Brij Kishore Singh with farsa on his head and Dhnanjay Ram snatched chain made of gold from his neck and also snatched Rs. 15,000/-. Pathal Ram assaulted Vinay Singh, the son of the informant. Ajay Ram assaulted Pradeep Singh with butt

Learned counsel for the petitioners submits that the there is counter version being Palanwa P.S. Case No. 111 of 2018. The injury found on the persons Vinay Singh, the son of the informant and Brij Kishroe Singh are simple in nature and caused by hard and blunt object. Pathal Ram and Vijay Ram are alleged to have assaulted the son-in-law of the informant with farsa, a sharp edged weapon, but the injuries are simple in nature. Considering the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxual, East Champaran at Motihari in connection with Palanwa P.S. Case No.110 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
