2. The petitioner is apprehending her arrest in connection with Ekangarsarai P.S. Case No. 46 of 2016 dated 12.03.2016 registered for the offence punishable u/ss 420, 467, 468, 471/ 120B of the Indian Penal Code and Section 3 of the Bihar Protection of Interest of Depositors (In Finance Establishment) Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have allured several persons
Patna High Court CR. MISC. No.40026 of 2024(2) dt.23-08-2024 2/3 to deposit the amount in the non-banking company which will be double in five years and triple in seven years. Subsequently, the petitioner and the Directors of the aforesaid company closed the local office and got disappeared.
4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Similarly situated co-accused has already been granted anticipatory bail by this court vide order dated 03.05.2024 passed in Cr. Misc No. 13673 of 2024. The petitioner is a lady who is only an agent of the aforesaid company. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Patna in connection with Ekangarsarai P.S. Case No. 46 of 2016, subject to conditions as laid down under
Patna High Court CR. MISC. No.40026 of 2024(2) dt.23-08-2024 3/3 section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
