Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Haspura PS case no. 221 of 2024 dated 06.08.2024, disclosing offences punishable under Sections 126(2) and other allied sections of B.N.S. Act.

The prosecution story, as per the First Information Report, is that on 05.08.2024, while the son of the informant namely Sudarshan Singh was working in the field, the petitioner along with other accused persons arrived there and assaulted informant's son by spade and lathi, due to which, he sustained injuries. 4.

Learned Counsel for the petitioner submits that petitioner is the grand son of the informant and there is dispute regarding partition between the family members. Referring to the injury report, learned counsel submits that all the injuries are simple

Patna High Court CR. MISC. No.35849 of 2025(2) dt.18-06-2025 2/2 in nature except injury no. 2, which is on the non-vital part of the body, inasmuch as the doctor has found the injury no. 2 as pain and swelling on the right leg.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that both parties are closely related having long-standing land dispute and injuries sustained by the informant's son are simple except injury no. 2, which is on the non-vital part of the body, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Daudnagar, Aurangabad in connection with Haspura PS case no. 221 of 2024, subject to the condition laid down under Section 482 of the Code of Criminal Procedure.
