The petitioners apprehend their arrest in Nalanda P.S. Case No. 52/2016, registered for the offences punishable under Section 306, 34 of the Indian Penal Code.
The mother of the deceased alleged that her daughter Arti @ Priti Kumari married to Dharmendra Kumar son of Indradeo Prasad resident of Sohankuan Mangla Asthan, P.S. - Laheri, District - Nalanda. Her son-in-law working in Kolkata. She alleged that her mother-in-law, brother-in-law were also abusing her daughter. Her daughter came to her Naihar on the eve of Raksha Bandhan, but whenever she talks to her husband her
Patna High Court Cr.Misc. No.25089 of 2016 (3) dt.18-08-2016 2/2 husband abused her. The informant alleged that her daughter set herself ablaze on account of torture by her husband and others. The petitioners are brother-in-law and mother-in-law of the deceased.
It appears that the deceased was living with her mother and father in her Naihar much prior from the date of occurrence. She had talk with her husband, but the informant did not allege that before the occurrence the deceased had talk with her brotherin-law or mother-in-law. Admittedly, the deceased committed suicide at her Naihar.
Considering the facts aforesaid and the fact that petitioners are brother-in-law and mother-in-law, the petitioners above-named , in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Biharsharif, Nalanda in connection with Nalanda P.S. Case No. 52/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
