This application for cancellation of anticipatory bail, which was granted to opposite party No. 2 vide order, dated 24.08.2015, passed in ABP No.5125 of 2015, in connection with Complaint Case No. 26919 (c) of 2014, has no merit inasmuch as there is no allegation that opposite
Patna High Court Cr.Misc. No.24420 of 2016 (2) dt.05-12-2016 2/2 party No. 2 ever misused the privilege of bail. Upon perusal of the materials available on the record, I find that the dispute between the parties is of civil nature and considering the nature of dispute, opposite party No. 2 was granted the privilege of anticipatory bail by the Court of learned Sessions Judge, Patna, vide order 24.08.2015.
This application has no merit and is, accordingly, dismissed.
