This application, for grant of regular bail, arises out of Buxar Town Police Station Case No. 168 of 2023, dated 22.03.2023, disclosing offences under Sections 457/380 of the Indian Penal Code.

The prosecution case, on the basis of First Information Report, is that three persons were trying to commit theft in the house of the Deputy Superintendent of Police, Buxar and when they were about to take away the invertor installed in that house, they were caught by the house guard of the Deputy Superintendent of Police at the spot.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to the fact

No.35674 of 2023(2) dt.28-06-2023 2/3 that the house guard of the Deputy Superintendent of Police used to sit in the tea stall and drink the tea without payment of price of the tea, which was being objected by the owner of the tea stall as well as the petitioner, the tea stall is situated in front of the house of the Deputy Superintendent of Police. Learned counsel further submits that no stolen article has been recovered from the possession of the petitioner. He next submits that the petitioner has got no criminal antecedent and similarly situated co-accused person, namely, Deepak Kumar Bhar @ Deepak Kumar, has been granted bail by a Co-ordinate Bench of this Court in Criminal Miscellaneous No. 31963 of 2023. He next submits that the petitioner is in custody since 23.03.2023.

Regards being had to the submissions made by the parties and taking into consideration the fact that the petitioner has got no criminal antecedents, no stolen article has been recovered form the possession of the petitioner and similarly situated co-accused person has been granted bail by a Coordinate Bench of this Court, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with
