====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 19-08-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner is languishing in jail custody since 25.05.2015 in connection with Sahiyara P.S. Case No. 46 of 2015 for offences alleged under Sections 363, 365, 368 and 120B of the Indian Penal Code.

The prosecution case is that on the secret information, the S.H.O, Sahiyara, Police Station along with other police officials, raided the house of one Ram Babu Rai of village Dihthi and recovered one minor boy Shivam Raj @ Bikendra Patel aged about 16 years. The said boy disclosed that about 27 days ago some unknown miscreants kidnapped him and since 12-13 days he was kept concealed at the house of Ram Babu Rai and the petitioner Kanti Devi was looking after him. He also disclosed that

It was also alleged that Ibrahim Ansari, Rambabu Rai and Harendra Sahni were involved in kidnapping and demand of Ransom and this petitioner was watching Shivam Raj to conceal him. It has been submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent and she does not have any knowledge about the said kidnapping. She was only assigned to look after the minor boy Shivam Raj. It has also been submitted that the victim has not been recovered from her possession and she neither has any knowledge that the miscreants demanded ransom to return the said boy.

Under such circumstances, let the petitioner Kanti Devi, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Sahiyara P.S. Case No. 46 of 2015.
