JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-08-2019 The learned counsel for the parties are in agreement that 90% amount of gratuity has already stood paid to the petitioner herein and in light of the Full Bench judgment reported in 2018(2) PLJR 933 (Arvind Kumar Singh vs. The State of Bihar & Ors.), balance 10 % amount of gratuity would be paid after completion of the ongoing departmental proceeding.
Accordingly, the learned counsel for the petitioner submits that the petitioner be granted liberty to agitate his grievances regarding non-payment of balance amount of gratuity immediately upon completion of the ongoing pending
Patna High Court CWJC No.1936 of 2018(7) dt.26-08-2019 2/2 departmental proceeding.
Having regard to the facts and circumstances of the case, the writ petition stands disposed off with the aforesaid liberty.
