At the very outset, learned counsel for the petitioner is directed to make necessary corrections in the prayer portion of this petition with regard to name and number of PS Case. This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed vide order dated 16.12.2021 passed in Cr. Misc. No. 30485/2021 with an observation that the petitioner may renew his prayer for bail after six months. Allegation as per FIR is that from possession of the petitioner one bag containing one country made pistols along with eleven cartridges were recovered.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.35509 of 2022(2) dt.13-07-2022 2/2 petitioner has falsely been implicated in this case by the police with oblique motive and the petitioner is in custody since 10.12.2020.

Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner and he is in custody since 10.12.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, namely, PUKARI YADAV be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Jamui in connection with Sikandara PS Case No. 278/2020, subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
