The petitioner has prayed for bail in a case registered for the offence punishable under sections 280, 282, 285, 337, 338, 188, 279, 270, 304 of the Indian Penal Code and Section 51(a)(b) of Disaster Management Act, 2005.
As per allegation in the FIR, petitioner is a boat sailor and he was sailing his boat rashly and negligently due to which his boat has strucked with 33000 volt of electric wire in which 31 passengers became injured and two persons are still traceless. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Due to mechanical fault, boat suddenly stopped in the middle of the Ganga river and struck with electric wore of 33000 Volt. No
Patna High Court CR. MISC. No.35821 of 2023(3) dt.19-07-2023 2/2 case is made out under Section 304 IPC. Petitioner has got no criminal antecedent and languishing in judicial custody since 21.3.2023.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Raghopur (Rustampur O.P.)
