JUSTICE RAKESH KUMAR ORAL ORDER 26-08-2015 Heard Sri Sanjeev Ranjan, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner in connection with Hisua P.S. Case no.191/2013 registered for the offence under Section 395 of the Indian Penal Code and Section 27 of the Arms Act. Earlier, the prayer for bail of the petitioner was rejected along with bail petition of coaccused Raushan Kumar @ Raushan @ Chirkut. Earlier by order dated 29.07.2015, a report was called for regarding stage of the case, which has been received and kept at Flag-X. The report indicates that presently the petitioner is in jail custody in Biharsharif and due to non production, trial of other two accused persons have been bifurcated.
Patna High Court Cr.Misc. No.32052 of 2015 (3) dt.26-08-2015 2/2 In view of the facts and circumstances, there is no ground for extending the privilege of bail to the petitioner. The petition stands dismissed.
