The present writ petition has been filed by the petitioners with the following reliefs:- "(a) For quashing the revised Final Result as contained in Memo No. 3896 dated 20.12.2024 issued pursuant to the Advertisement No. 01/2019 by the Bihar Technical Service Commission whereby and whereunder the Petitioners were illegally and unjustly overlooked for selection whereas several other candidates, who were illegally allowed to participate in the selection process even after the cut-off date stipulated by Clause 15 of the Advertisement No. 01/2019, were selected and appointed to the posts of Junior Engineer (Civil, Mechanical and Electrical).
(b) To direct the Respondents Bihar Technical Service Commission to
11/16 recommend the names of the Petitioners against the vacant posts of Junior Engineer (Civil) pursuant to the Advertisement No. 01/2019 and consequently, direct the Respondent State to appoint the Petitioners against the available vacant posts of Junior Engineer (Civil) with all consequential benefits including seniority, arrears of salary etc.
(c) To direct the Respondents concerned not to make any further appointment to the posts of Junior Engineer (Civil, Mechanical and Electrical) pursuant to the Advertisement No. 01/2019 issued by the Bihar Technical Service Commission during the pendency of the present writ application.
(d) To pass any other order/orders in shape of a consequential relief to which the Petitioner may be found to be legally entitled to in the facts and circumstances of the instant case at hand."
3. Learned Counsel for the petitioners submits that due to amendment made in the advertisement, more persons were admitted to appear in the examination process. Counsel for the petitioners submits that since more persons appeared in the examination process, who were initially not eligible on the date of advertisement, have now permitted to appear in the

But, subsequently, after publishing the result he realized that the said permission for extension of the appearance in the said advertisement is basically not proper and it is illegal. He further submits that since the petitioners were not selected, therefore, the prayer has been made to stop the further process of appointment and the result be kept in abeyance till disposal of the case.
4. In support of his argument, Counsel for the petitioners submits that some other persons have filed different writs with same relief and their cases are pending for disposal. In some of the writ petition, order have been passed that the final result shall be subject to decision of the said writ petition. It is, therefore, learned Counsel for the petitioners prays two fold prayer before this Court. Firstly, he submits that the result be kept in abeyance and secondly that the present writ petition be tagged with the writ petitions which are pending for disposal before this Hon'ble Court.
5. Learned Counsel for the Bihar Technical Service Commission submits that the present writ petition is fit to be dismissed due to the reason that petitioners have no grievance when the said letter for extension of period has been made in the year 2020 i.e., 03.02.2020, but when they have not
13/16 been selected finally, then only they want to stop the selection process, which shows the ill motive of the petitioners. Learned Counsel for the Commission further submits that by virtue of extension of the period of filing the application form is not in violation of any law; rather it is completely in accordance with law. He submits that Clauses 15 of the advertisement No.1 of 2019 issued by the Bihar Technical Service Commission, clearly indicates that the candidates, who shall appear in selection process, must have the certificates prior to the last date of filling of the form.
He submits that since the time of filling of form has been extended then automatically those candidates who become eligible after the initial cut-off date has also appeared in the examination process as there was no cut off date for eligibility criteria mentioned in the advertisement. He submits that Rule of game has not been changed; rather according to the instruction of the department and as per the circular, the time for filling application form has been extended. Due to extention of time for filing the application, some more candidates in simplicitor have become eligible to appear in the examination. This advertisement was admittedly come after a long period of time i.e., after more than eight years.
14/16 that whosoever become eligible to appear in selection process shall be considered. In support of his argument, Counsel for the petitioners relied on the decisions of Ashok Kumar Sonkar Vs. Union of India and Others reported in (2007) 4 SCC 54 and Divya Vs. Union of India and Others reported in (2024) 1 Supreme Court Cases 448. He specifically relied on paragraph-51, which states that it is also very well settled that if there are relevant rules which prescribes the date on which the eligibility should be possessed, those rules will prevail. In absence of rules or any other dates prescribed in the advertisement for determining the eligibility, there is a judicial chorus holding that it would be the last date for submission of the application.
6. In support of his argument, learned Counsel for the Commission submits that the present petitioners have no case at all, particularly due to two reasons. Firstly, the petitioners have raised objection after the final selection and requesting to stop publication of the final selection list. Secondly, in the light of the latest decision of Hon'ble Supreme Court in Divya's case (supra) that there was no rule or any other dates prescribed in the advertisement for determining the eligibility; rather the date was fixed as last date for submission

In the light of the submissions made by the parties, this Court reached on the conclusion that admittedly the petitioners have appeared in the selection process and during the said period they have raised no objection; rather they raised objection only after publication of final select list and found that they have not selected. It also transpires to this Court that in the advertisement itself there was no cut-off date or rule determining the eligibility date rather the only thing mentioned that the eligibility should be hold for any candidate for the last date of acceptance of online application.
Here in the present case, on the instruction of the requisitioning department, the Commission has extended the date and no rule has been changed in the advertisement; rather due to the statement of the advertisement the benefits become available to those persons who become eligible due to extension of filling the date of application form. This Court also after reading the case of Divya, case (supra), specifically mentioned in paragraph 51 which reads as follows:- "It is also very well settled that if there are relevant rules which prescribes the date on which the eligibility should be possessed, those rules will prevail.
16/16 In absence of rules or any other date, prescribed in the advertisement for determining the eligibility, there is a judicial chorus holding that it would be the last date for submission of the application."

This Court is of the firm view that the petitioners have no case at all as they have not raised any objection earlier; rather after final selection they want to create hurdle in the final result, which this Court shall not permit to the petitioners. So far as the other cases are concerned, which the petitioners have annexed in the writ petition, this Court is not observing any finding relating to those cases as those cases shall be decided on its own merit. From the findings of Hon'ble Supreme Court in Divya's case (Supra), it is clear that in absence of rules or any other date prescribed in the advertisement determining the eligibility, it would be the last date for submission of application form shall prevail.
9. In the light of the reasons mentioned above, this writ petition is dismissed.
