The petitioner seeks bail in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The petitioner lifted 5000.00 quintals of paddy and he had to deliver 3350.00 quintals of C.M.R., but he did not deposit the required C.M.R. and thereby the petitioner is alleged to have misappropriated a sum of Rs. 72, 56,626/-. A certificate case is also going on for realization of the aforesaid amount. It is submitted that it is a case of breach of agreement between the B.S.F.C. and the rice millers.

Learned counsel for the B.S.F.C. did not dispute the facts.

Having taken into consideration the facts aforesaid and

Patna High Court Cr.Misc. No.36109 of 2015 (3) dt.01-10-2015 2/2 the facts that the petitioner is in jail since 01.06.2015, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in Ramgarh P.S. Case No. 86 of 2015.
