This application has been filed for grant of regular bail in connection with Dalsingsarai P.S. Case No. 68 / 2023 registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner is that when the informant was returning home three unknown persons including the petitioner on a motorcycle stopped the informant and snatched his mobile phone and motorcycle at gun point.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. and during the investigation he was arrested on the basis of confessional

Patna High Court CR. MISC. No.35608 of 2023(2) dt.07-07-2023 2/2 statement of the co-accused. There is no recovery from the possession of the petitioner or from his house or shop. Petitioner has not been put to T.I.P. Petitioner has no criminal antecedent and is in jail custody since 25.03.2023.

Learned APP for the State has vehemently opposed the prayer of bail.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Dalsingsarai District Samstipur in connection with Dalsingsarai P.S.
