Petitioner is apprehending his arrest in connection with Chenari P.S.Case No.180 of 2018 , registered for offences punishable under Sections 341, 342, 323, 324, 386, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution case is of demand of Rangdari by the petitioner from the informant, who is a hotel owner and also assaulting him and snatching of Rs.32,000/- from his counter and demanding Rs.25,000/- from him.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case as he had made complaint about the selling of the liquor by the informant and as such he has been falsely implicated in this
Patna High Court CR. MISC. No.33060 of 2019(5) dt.05-09-2019 2/2 case and the injury report will also disclose the serious injury on the body of the person . He has no criminal antecedent. Heard learned A.P.P. , who has opposed the prayer for bail..
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM II, Sasaram, Rohtas in connection with Chenari P.S.Case No.180 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation, otherwise his bail bond shall be cancelled.
