JUSTICE PURNENDU SINGH ORAL ORDER 09-09-2025 Heard Mr. Diwakar Prasad Singh, learned counsel appearing on behalf of the petitioner; Mr. Sanjay Kumar, learned counsel appearing on behalf of the opposite party no. 2 and Mr. Satya Nand Shukla, learned counsel for the State.
2. The petitioner has sought quashing of the order dated 19.03.2025 passed in Criminal Revision No. 111 of 2024/ CIS No. 111of 2024 by which order dated 04.07.2024 passed by learned C.J.M., Purnea in C.A. Case No. 1365 of 2018 was set aside.
3. At the outset, learned counsel appearing on behalf of the opposite party no. 2 submitted that in view of the fact that
Patna High Court CR. MISC. No.42923 of 2025(4) dt.09-09-2025 2/2 already cognizance has been taken by the learned A.C.J.M. vide order dated 10.07.2025 relating to Complaint Case No. 1365 of 2018 and subsequent development has not been challenged by the petitioner, the present quashing application for quashing of order dated 19.03.2025 passed in Criminal Revision No. 111 of 2024 at the threshold is not maintainable.
4. At this stage, learned counsel appearing on behalf of the petitioner seeks to withdraw the present quashing application with a liberty to challenge the order taking cognizance.
5. Accordingly, the present quashing application stands disposed of.
