2. The petitioner seeks bail in connection with Dariyapur P.S. Case No. 14 of 2023 registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is alleged to have committed a loot of Rs. 2.14 lacs from a person.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has committed no offence and other co-accused has already been granted bail from a coordinate Bench of this Court.

5. Learned counsel for the petitioner further submits that the petitioner is in custody since 31.05.2023.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the fact that the petitioner is in custody since 31.05.2023 and also the fact that similarly situated coaccused has been granted bail, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Saran at Chapra, DistrictSaran/concerned Court in connection with Dariyapur P.S. Case No. 14 of 2023, subject to the condition that the petitioner will co-operate in the trial.
