The petitioners apprehend their arrest in connection with Janta Bazar P.S. Case No. 141/2018 registered for the offense punishable under Sections 366A/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are the family members of the main accused Nipun Kumar who is alleged to have kidnapped the daughter of the informant. Learned counsel for the petitioners submits that though the said Nipun Kumar has been taken into custody from his own home, the petitioners being the family members of the said Nipun Kumar are facing threat of prosecution and,
Patna High Court CR. MISC. No.33712 of 2019(2) dt.22-05-2019 2/2 therefore, seek pre-arrest bail. Learned counsel for the petitioner submits that actually the victim girl is a major and has run away with some other person, but the petitioners are being victimized and harassed on behalf of the present F.I.R. It is further submitted that the said Nipun Kumar is in jail and these petitioners have no other criminal antecedent. In view of the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 5, Saran, in connection with Janta Bazar P.S. Case No. 141/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
