According to the prosecution case itself, alleged occurrence took place on 7.7.2014 whereas present case was lodged on 20.7.2014 i.e. after 13 days of the alleged occurrence. It would appear from perusal of para 33 of the case diary that before institution of the aforesaid case, sanha no. 212/14 was registered on the basis of written report of the informant and in the aforesaid sanha, informant disclosed that he was caught in fire due to fall of earthen lamp. The injured was initially, examined by doctor, Primary Health Centre, Goh who reported that the informant sustained simple injury but when informant was examined by doctor of Anugrah Narain Medical College, Gaya, the said doctor reported that informant sustained grievous injury.

Considering the aforesaid facts and circumstances as well as

No.33413 of 2015 (3) dt.16-10-2015 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Daudnagar District Aurangabad in Uphara P.S. Case no. 31/2014.
