1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Barauli P.S. Case no.163 of 2024 registered under sections 304B, 506, 120B and 34 of the Indian Penal Code.
3. As per the prosecution case, the daughter of the informant who was married to the petitioner was physically and mentally tortured for non-fulfillment of demand of dowry and ultimately done to death.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case only for the reason of his being the husband of the deceased. The earlier prayer for bail of the petitioner was rejected vide order dated 24.2.2025 passed in Cr. Misc. no.77539 of 2024
Patna High Court CR. MISC. No.34790 of 2025(2) dt.10-06-2025 2/3 giving liberty to the petitioner to renew his prayer for bail after examination of the informant. Learned counsel further submits that the informant has been examined as P.W.3 in the learned trial Court and the deposition has been brought on record as Annexure-3 to the petition. It is submitted that from the contents thereof, it cannot be said that the case of the prosecution has been substantially supported. The petitioner is in custody since 16.7.2024, has no criminal antecedent and undertakes to abide by the conditions which may be laid by this Court for his release on bail.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material on record, the liberty granted in the earlier order of rejection dated 24.2.2025, the petitioner being in custody since 16.7.2024 and the informant having been examined in the learned trial Court, the Court directs the petitioner to be enlarged on bail in connection with Barauli P.S. Case no.163 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj on the following
Patna High Court CR. MISC. No.34790 of 2025(2) dt.10-06-2025 3/3 conditions:
(i) The petitioner shall remain physically present in Court on each date of the trial and shall cooperate in the trial. (ii) In case of the petitioner's absence on any date for reasons not to the satisfaction of the learned trial court or in case the trial Court is of the opinion that the trial is being delayed due to non-cooperation of the petitioner, the learned trial court may cancel the bail bond of the petitioner and take him into custody till conclusion of the trial.
