The petitioner is languishing in custody since 24.03.2019 in a case registered for the offences punishable under Sections 341, 323, 324, 382 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act, 2016. It is alleged that the petitioner and other co-accused persons tried to take away the truck of the informant as they were also in inebriated condition. They assaulted the informant side and snatched Rs.7700/-.

It is submitted by learned counsel for the petitioner that the petitioner also lodged Nawada Town P.S. Case No. 349 of 2019 against the informant with accusation of assault and taking away the truck of the informant, though the petitioner

Patna High Court CR. MISC. No.35197 of 2019(2) dt.29-05-2019 2/2 and informant are co-villagers.

Learned APP submits that the accusation is specific against the petitioner.

Considering the nature of accusation, investigation has already been concluded and there being a counter case filed from the petitioner's side, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II -cum- Special Judge, Nawada in connection with Nawada Town P.S. Case No. 346 of 2019. (Dinesh Kumar Singh, J) DKS/- U T
