====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Supaul P.S. Case No. 860 of 2022 dated 09.09.2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that the petitioner has fair and clean antecedent and has been languishing in jail since 13.02.2023 and against him the investigation has been completed and as per the prosecution, Rs. 10,000/- and victim's Aadhar card photocopy are stated to have been recovered from the house of this petitioner and the said recovery is completely false and the alleged recovered cash belongs to the

It is further submitted that the petitioner's name surfaced in the alleged crime in the confessional statement of co-accused Bipin Kumar and except this there is no any other material against him.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's fair and clean antecedent and completion of the investigation against him, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail, after framing of charge, on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Supaul P.S.
