JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-12-2015 Heard the learned counsel for the petitioner as well as the learned A.P.P.

The petitioner seeks bail in a case for the offences punishable under sections 392, 395 and 412 of the I.P.C The petitioner is not named in the FIR. During the course of investigation Manoj Yadav was apprehended who disclosed the name of the petitioner and from possession of the petitioner Rs. 19,000/- is said to have been recovered. The petitioner is not put on test identification parade nor the money was identified by the informant. The informant has not given any identification mark of the looted money and the petitioner is in custody since 20.04.2015.

In the facts and circumstances as stated above, the

No.32673 of 2015 (4) dt.07-12-2015 2/2 petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Jamui in Jhajha P.S. Case No. 53 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
