Mr. Vijay Kumar Sinha, learned counsel appearing on behalf of the petitioner, in view of the stand taken on behalf of State of Bihar in the counter affidavit that the petitioner should have approached the Appellate Authority, seeks this Court's liberty to prefer an appeal against the impugned order dated 06.03.2020, passed by the Sub-Divisional Officer-cumLicensing Authority, Chakiya in the District of East-Champaran,

Patna High Court CWJC No.10406 of 2020(7) dt.03-02-2022 2/2 whereby his licence to run a PDS shop has been cancelled. The petitioner filed this writ application in December, 2020. Be that as it may, considering the facts and circumstances of the case, this application is disposed of with a liberty to the petitioner to prefer an appeal against the said order with an application seeking condonation of delay. The application seeking condonation of delay shall be considered on its own merits. It is further observed that the Appellate Authority shall consider deciding the appeal expeditiously in accordance with the provisions under Bihar Targeted Public Distribution System (Control) Order, 2016.
