JUSTICE ASHUTOSH KUMAR) Date : 22-09-2022 Heard Mr. Sanjay Kumar Pandey, learned Advocate for the petitioner and Mr. Upendra Pratap Singh, for the State. A peculiar petition has been filed by the writ petitioner ventilating his grievance with respect to the decision taken by the District Level Selection Committee with respect to such shops for which there should not have been any advertisement as there was pendency of litigation with respect to grant of licence.

In a general manner, this petitioner appears to have challenged such decision of the District Selection Committee before District Magistrate which was rejected on the ground that the District Magistrate being part of the District Selection Committee would not be in a position to review the order passed by the District Selection Committee.

Patna High Court CWJC No.14114 of 2021 dt.22-09-2022 3/3 We do not find any fault in the order passed by the District Magistrate under Section 32 of the Bihar Targeted Public Distribution System (Control) Order, 2016. However, the petitioner, if so advised, may approach the concerned authority, viz. the Divisional Commissioner for the redressal of his grievances.

The petition is accordingly dismissed.
