The petitioner seeks bail in Begusarai (Muffasil) P.S. Case No.292 of 2004 instituted for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier this Court vide order dated 21.3.2014 passed in Cr. Misc. No.47347 of 2013 rejected the prayer for bail of the petitioner with an observation to expedite the trial. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, Judicial Magistrate, Ist
Patna High Court Cr.Misc. No.33676 of 2015 (4) dt.13-01-2016 Class, Begusarai is directed that on receipt of the order he will commit the case to the court of session and court of session after receipt of the file from the Judicial Magistrate, Ist Class will expedite the trial and conclude the same within a period of one year from the date of receipt of the record of the case.
