The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections147, 148, 149, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Submission is that the petitioner is not named in the F.I.R. but during course of investigation in para-56 and 57 of the case diary Umesh Singh has stated that other accused persons have taken meal of fish in the depot of Pawan Choudhary (petitioner). Similar statement has been made by the other prosecution witness. There is no evidence come out in the case diary that petitioner is involved in this case.

No.36036 of 2019(2) dt.11-06-2019 2/2 In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Mufassil Police Station Case No. 683 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
