The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The petitioners are brother-in-law and sister-in-law of the deceased. The informant is not an eye witness of the occurrence. The husband of the deceased has not been made accused. On hearsay evidence the petitioners are rotting in jail since 29.04.2015. Similarly situated co-accused Md. Sabir and Bibi Tuski have already been enlarged on bail vide orders passed in Cr. Misc. No. 5514 of 2012.

Considering the facts aforesaid, the petitioners above

Patna High Court Cr.Misc. No.30855 of 2015 (2) dt.17-08-2015 2/2 named are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Jokihat (Mahalgaon) P.S. Case No. 240 of 2011.
