Petitioner is apprehending his arrest in connection with Teghara P.S.Case No.53 of 2016 dated 19.2.2016, registered for offences punishable under Sections 448, 341, 323, 354, 504 of the Indian Penal Code.

Allegation against the petitioner is that the petitioner came in the house of the informant and trying to forcibly take water pipe from her house and when she protested he tried to misbehave with her and outrage her modesty and further allegation is that he has assaulted her.

Submission of the learned counsel for the petitioner is that he is a retired army personnel and nothing happens like that rather the dispute arose with respect to irrigating the field

Patna High Court CR. MISC. No.33631 of 2019(3) dt.02-08-2019 2/2 of the petitioner, which is situated just beside the house of the informant and the injury report also discloses that the same is simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Rajeev Kumar, CJM, Ist Class, Begusarai in connection with Teghra P.S.Case No.53 of 2016 dated 19.2.2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
