The petitioner apprehends his arrest in a case registered under Section 366(A) of the Indian Penal Code. As per the written report, informant suspects kidnapping of her minor daughter either by the petitioner Rajnish Kumar or by Manish Kumar as Rajnish Kumar was in talking term with his daughter.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village politics. As a matter of fact, the victim in her statement recorded under Section 164 Cr.P.C. has explicitly stated that she was in love with one Jagarnath Mishra and she
Patna High Court CR. MISC. No.32761 of 2019(2) dt.17-05-2019 2/2 has suo motu left her house for Jagarnath Mishra and performed marriage with him in Brahmpur out of her sweet will. No one has mounted pressure upon him. Petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramganj, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 253 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
