IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.33188 of 2015 Arising Out of PS.Case No. -247 Year- 2014 Thana -GOPALPUR District- BHAGALPUR ======================================================

1. Mukesh Singh Son of Bindeshwari Singh Resident of village - Dharhara, P.S. Gopalpur, District - Bhagalpur .... .... Petitioner/s

Versus

1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Ranjeet Kumar Singh -Advocate For the Opposite Party/s : Mr. Chandra Bhushan Pd.(APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

Learned APP has submitted that from the report sent by Superintendent of Police, Naugachia, Bhagalpur vide Memo No. 1517/P.Cell dated 07.12.2015, it is evident that all the prosecution witnesses have already been examined.

Statement of accused has also been recorded.

That being so as well as considering the complicity of the petitioner in the alleged crime, I do not see it a good case for reconsideration. Prayer for bail is rejected. In case, there happens to be active co-operation at the end of petitioner, then in that event, the learned lower court will proceed with the trial on day-to-day basis and conclude the same within two months positively. perwez (Aditya Kumar Trivedi, J) U T
