JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 379/307 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have given Farsa blow on the head of the father of the informant as a result of which he sustained head injury.

Learned counsel for the petitioner submits that the dispute arose between the parties over cutting of a ridge and as such the alleged incident was not preoccupied. Besides, present case is the counter blast of Chautarwa (Bathwariya) Police Station Case No. 63 of 2021 lodged by the petitioner against the informant and his family members. It is further submitted that the doctor who examined the injured found the injury to be caused by the hard and blunt substance. Petitioner has claimed clean antecedent and he is in custody since 17.6.2021. Considering the aforesaid facts and circumstances of
