JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report and admittedly, the present case was lodged on 17.04.2015 for the occurrence of 16.04.2015 and prior to institution of the present case, the informant lodged another case i.e. Brahampur ( Chhki O.P) P.S.Case N. 95 of 2015 for the same occurrence. Moreover, petitioner no. 2 happens to be co-villagers of the informant whereas petitioner no. 1 is resident of another village. Petitioner no. 1 was put on T.I.P but he was not identified by the informant. It is also relevant to mention here that the informant did not make any allegation of rape against the petitioners in Brahampur ( Chhki

Accordingly, petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar ( Mahila) P.S.Case No. 10 of 2015.
