JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-05-2019 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 21.02.2019 in a case registered for the offences punishable under Sections 379 and 411 of the IPC.

It is alleged that the petitioner along with co-accused Md. Isharul was caught while fleeing away with Passion Pro motorcycle of the informant.

It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner, the investigation has already been concluded and a statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner is named in the FIR with specific accusation.

Case No. 21 of 2019.
