The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 34 of the Indian Penal Code.

As per prosecution case, the dead body of the deceased was found hanging on a mango tree and an U.D. case was registered. Subsequently after investigation, this FIR was lodged.

Patna High Court CR. MISC. No.36360 of 2023(2) dt.03-07-2023 2/3 Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to dirty village politics. The petitioners have no concern with the alleged occurrence and nothing incriminating article has been recovered from their conscious possession. They have got no criminal antecedent. Similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 25.10.2021 passed in Cr. Misc. No. 30376 of 2021. It is further submitted that the petitioners are languishing in judicial custody since 13.09.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Laukahi P.S.
