Mr. Ajay Kumar Sharma (Ac To Ag) ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 09-12-2021 Heard learned counsels for the respective parties. In the instant petition, petitioner has prayed for the following reliefs:

"For issuance of an appropriate writ/order/direction for revoking/setting aside the order of suspension of the petitioner as contained in the Patna District Order No. 4467/2011 contained in Memo No. 15023 dated 13.09.2011 issued by the Senior Superintendent of Police, Patna as well as the entire Departmental Proceeding bearing No. 66/12 including Memo of Charge bearing Memo No. 17227 dated 19.10.2011 alleging involvement of the petitioner in connection with Buxar Town Police Station Case No. 231/11and his arrest in that murder case in which he has been acquitted by the Hon'ble Court subsequently."

Patna High Court CWJC No.2922 of 2018 dt.09-12-2021 2/2 Petitioner has questioned the validity of suspension order dated 13.09.2011. During pendency of the present petition on 11.07.2020 order of suspension was revoked. If the disciplinary proceedings are concluded in imposition of penalty, in that event, the suspension period from 13.09.2011 to 11.07.2020 is to be regularised in accordance with the relevant provision of law. The above exercise shall be completed within a period of three months from the date of receipt of this order. In view of the aforesaid development, the present petition does not servive for consideration, reserving liberty to petitioner to question the validity of regularisation of suspension period.

Accordingly, the present petition stands disposed off.
