Petitioner Dharambir Kumar @ Dharmabir Yadav is an accused in a case registered for the offence under sections 307/302 and other allied sections of the Indian Penal Code. The petitioner has averred in the instant bail application that he has no criminal antecedent. Similar submission had also been made on behalf of the petitioner at the time of passing of the impugned order dated 15.4.2019. However, when this Court took notice of this fact under its order dated 17.8.2019, learned counsel appearing for the petitioner filed supplementary affidavit dated 2.9.2019 to the effect that five cases are pending against the petitioner. In view of order of this Court dated 30.8.2019, report of the SSP, Darhanga dated 9.9.219 is on record which discloses

Patna High Court CR. MISC. No.33220 of 2019(5) dt.16-10-2019 2/2 that the petitioner Dharambir Kumar @ Dharmabir Yadav has criminal antecedent as five criminal cases are pending against him.

This being the conduct of the petitioner, I am not inclined to grant him bail in the instant case. The bail application is rejected.
