The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/328/34 of the Indian Penal Code.

Prosecution case is that petitioner and other accused persons administered poison causing death of son of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is brother-in-law (Sarhu) of the deceased and police after investigation submitted final form exonerating him from the allegation. However, the trial court took cognizance of the offence also against the petitioner and summoned him. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Danapur, Patna in Paliganj Police Station Case No. 247 of 2009, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
