The petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

It is submitted that the case has been lodged against unknown. The names of the petitioner and some other co-accused have appeared in the confessional statement of co-accused Gorelal Tanti. The petitioner has been in custody since 20.3.2015. In similar facts and circumstances, co-accused Makeshwar Yadav has been granted bail vide Cr. Misc. no. 24942 of 2010. Learned counsel for the State could not controvert the contention of the learned counsel for the petitioner while opposing the prayer for bail. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.32779 of 2015 (2) dt.17-08-2015 2 / 2 amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul, in G.R.P. Jhajha P.S. Case No. 3 of 2007 (G.R. no. 6 of 2007) with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence on two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
