2. The petitioners are in custody in a case registered for the offence punishable under Sections 103(1) and 3(5) of the BNS, 2023.

3. As per allegation in the FIR, the informant's father was working in the field, and in the meantime, Mannu Gope and Subelal Prasad along with some unknown came and assaulted his father brutally, due to which, he sustained injury on his head, heart and hand after that he was taken to Patna for better treatment and during course of treatment, the father of the

Patna High Court CR. MISC. No.36669 of 2026(3) dt.28-07-2026 2/2 informant died.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that both the petitioners are female and they are not named in the FIR, there is land dispute between the parties and no specific allegation of assault against both the petitioners. Petitioners are in custody since 03.04.2026.

5. Learned counsel for the State as well as learned counsel for the Informant have opposed the prayer for bail of the petitioners and submits that there is direct allegation of assault upon the father of the informant.

6. In the light of the aforesaid submissions as made by learned counsel for the petitioners as well as the fact that both the petitioners are female so, let the above named both petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Biharsharif/concerned Court in connection with Sare P.S. Case No. 41 of 2026.
