JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named and it is alleged that he along with several other FIR named accused assaulted the deceased with stone as a result of which, deceased died then and there. The informant claimed herself to be eye witness of the alleged occurrence.

Submission on behalf of the petitioner is that having more or less similar allegation, co-accused namely, Ragho Yadav, Baleshwar Yadav and Sukhdeo Yadav have already been granted privilege of bail by different benches of this court. It is further contended by him that petitioner is in jail custody for near about 7 months without having any criminal antecedent.

No.31349 of 2015 (5) dt.01-12-2015 2/2 Considering the above-said submission as well as facts and circumstances of the case, with a view to maintain the parity of justice, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sheikhpura P.S. Case No. 311 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura.
