Despite repeated calls, none appeared on behalf of the petitioner, whereas the learned counsel for the informant is in appearance.

The petitioner was granted provisional anticipatory bail, vide order 11.05.2022, on the assurance that he would keep the victim with full dignity and honour. The victim was also present on that day and she expressed her willingness to go with the petitioner to her matrimonial house.

The learned counsel for the informant has submitted that on 11th of May, 2022, the couple exited

No.45450 of 2021(10) dt.31-08-2022 2/2 from the Court room after court's proceeding and thereafter, the petitioner went from the Court premises after leaving his wife in the Court premises and that matter was brought to the notice of this Court on the same day and the case was posted for 16.05.2022. This fact was mentioned in the order dated 16.05.2022.

The reluctance as well as apathy in restoring the matrimonial harmony is apparent as non-appearance on behalf of the petitioner despite repeated calls.

Considering the above-mentioned facts and also considering that the petitioner in spite of his assurance to keep the informant, went leaving the informant in the Court premises the anticipatory bail petition of the petitioner is dismissed. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
