2. The petitioner seeks bail in connection with Marhauraha P.S. Case No. 111 of 2016 registered for the offences under Sections 414, 399 and 402 of the Indian Penal Code.

3. The petitioner is named in the F.I.R. and is in custody since 16.02.2024.

4. The allegation against the petitioner is to involve in preparations for dacoity alongwith other coaccused persons.

5. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner surfaced in the present case during the course of investigation on the basis of confessional statement of co-accused Ashok Nut @ Gulteni, in furtherance of which, nothing incriminating recovered/surfaced during the course of investigation, which may suggest, prima facie, involvement of petitioner, qua, preparations for dacoity. While concluding the argument it is submitted that petitioner found involved in three more criminal cases of year 2015 & 2016, where he is on bail and moreover, investigation has been completed, for which, chargesheet has been submitted, as such, there is now no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of the facts and circumstances as mentioned above as implication of petitioner in the present case, prima facie, appears on the basis of

No.40990 of 2024(2) dt.12-06-2024 3/3 suspicion arising out of confessional statement of coaccused, coupled with the fact as petitioner is in custody since 16.02.2024, where charge-sheet has already submitted, accordingly, petitioner, above named, is directed to be released on bail in connection with Marhauraha P.S. Case No. 111 of 2016 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C.
