JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2022 Though the present writ petition has been filed for quashing the notice dated 8.9.2020, issued by the Circle Officer, Ballia i.e. the Respondent No. 3 regarding measurement of the land in question, however, during the pendency of the present writ petition, the land in question has already been measured and the Anchal Amin has submitted a report, whereafter the Respondent No. 3 is intending to initiate encroachment proceedings, however, till date, no encroachment proceeding has been initiated.

In such view of the matter, the learned counsel for the petitioner seeks a direction upon

Patna High Court CWJC No.56 of 2021(3) dt.18-08-2022 2/2 the Respondent No. 3 that in case, appropriate encroachment proceedings are initiated, the show cause reply and the documents annexed therewith, to be filed by the petitioner apart from the documents already filed by the petitioner, be considered and after dealing with the same, appropriate orders be passed. It is directed accordingly.

The writ petition stands disposed of.
