The petitioner seeks appointment on Class IV post, inter alia, on grounds that he has been working on Group-D post, albeit on daily wages since 1996.

A counter affidavit is filed and paragraph 10 of the counter affidavit while accepting the fact of continuation of the petitioner on daily wages mentions that the petitioner does not fulfil the educational qualification for such appointment inasmuch as in terms of the notification bearing No. 16970 dated 12.12.2012 the qualification is 10th Pass but the petitioner is a 9th Pass and thus, does not fulfil the eligibility criteria.

Patna High Court CWJC No.5005 of 2016 (2) dt.05-03-2018 In the circumstances discussed, no ground for indulgence is made out.
